Expulsion of a gardener &#8211; Destruction of property (2014)"},"content":{"rendered":"<p>A citizen was expelled from the Laurier community garden, in Arrondissement de Rosemont &#8211; La Petite-Patrie, where she had been gardening for about a decade.\u00a0 However, the Garden Committee had not respected the procedure provided for in the <em>R\u00e8gles de civisme et de jardinage<\/em> applicable in this Borough.\u00a0 These rules provide for a gradation of sanctions and impose that written notices be given to the gardener, identifying the available recourses to contest the sanction.\u00a0 In light of these non-compliances, the <strong>OdM <\/strong>recommends the cancellation of the <em>Notice of expulsion<\/em> as well as the reinstatement of the gardener: <strong>Recommendation refused.<\/strong>\u00a0 The Borough offered the gardener the option of registering at another garden.\u00a0 This offer was refused since the citizen found it too far from her residence.<\/p>\n<p>&nbsp;<\/p>\n<p>During the investigation, we had agreed with the Borough that the plaintiff\u2019s tools and other gardening goods, still at the community garden, would be kept so she could retrieve them.\u00a0 Nonetheless, a member of the Garden Committee threw them away.\u00a0 We were able to obtain a financial compensation from the Borough.\u00a0 This aspect of the file was settled to the plaintiff\u2019s satisfaction.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A citizen was expelled from the Laurier community garden, in Arrondissement de Rosemont &#8211;
