{"id":4148,"date":"2015-06-22T09:38:21","date_gmt":"2015-06-22T13:38:21","guid":{"rendered":"https:\/\/ombudsmandemontreal.com\/?page_id=4148"},"modified":"2015-06-22T09:38:21","modified_gmt":"2015-06-22T13:38:21","slug":"park-fees-cancelled-delay-of-over-two-months-between-a-notice-of-motion-and-the-adoption-of-the-new-regulation-2014","status":"publish","type":"page","link":"https:\/\/ombudsmandemontreal.com\/en\/cases-handled\/examples-of-cases-handled\/urbanism-and-maintenance\/park-fees-cancelled-delay-of-over-two-months-between-a-notice-of-motion-and-the-adoption-of-the-new-regulation-2014","title":{"rendered":"&#8220;Park fees&#8221; cancelled &#8211; Delay of over two months between a Notice of motion and the adoption of the new regulation (2014)"},"content":{"rendered":"<p>Co-owners in Arrondissement Le Plateau-Mont-Royal submit that their project should not be subject to the new \u201cpark fees\u201d prescribed in a new By-law that was adopted after the filing of their permit application.\u00a0 Their request had been filed after the issuance of a <em>Notice of motion <\/em>announcing the new By-law which had the effect of suspending all permit issuances for a period of two months.\u00a0 However, the new By-law was not adopted within the two months following the <em>Notice of motion.\u00a0 <\/em>After analysis of the law and review of the caselaw, we expressed the opinion that, after the two-month period, the \u201cfreeze\u201d had ceased to be in effect and the permit should have been issued.\u00a0 Following our <strong>Recommendation<\/strong>, the Borough issued the permit, without imposing the new \u201cpark fees\u201d.<\/p>\n<p>With a view to ensure fairness to all its citizens, the Borough informed us that it would take the same approach and not charge the new \u201cpark fees\u201d in other similar files which we had not investigated.
