{"id":408,"date":"2011-07-07T15:03:08","date_gmt":"2011-07-07T19:03:08","guid":{"rendered":"https:\/\/ombudsmandemontreal.com\/?page_id=408"},"modified":"2022-02-08T16:08:37","modified_gmt":"2022-02-08T21:08:37","slug":"montreal-charter-of-rights-and-responsibilities","status":"publish","type":"page","link":"https:\/\/ombudsmandemontreal.com\/en\/our-services\/montreal-charter-of-rights-and-responsibilities","title":{"rendered":"Montr\u00e9al Charter of Rights and Responsibilities"},"content":{"rendered":"<div id=\"content\">\n<h2>Montr\u00e9al Charter of Rights and Responsibilities<\/h2>\n<p>Ville de Montr\u00e9al is one of the very few places, worldwide, with a municipal charter of rights clearly outlining the City\u2019s fundamental values and commitments. The <em><a href=\"https:\/\/montreal.ca\/en\/topics\/montreal-charter-rights-and-responsibilities\" target=\"_blank\" rel=\"noopener\">Montr\u00e9al Charter of Rights and Responsibilities<\/a><\/em> (or the \u201cMCRR\u201d) is a groundbreaking document with no known equivalent: UNESCO and UN-HABITAT have shown great interest in this charter and consider it as a model to be followed.<\/p>\n<p>The MCRR came into effect on January 1, 2006. It is drafted around seven central themes:<\/p>\n<ul class=\"bullets\">\n<li>Democracy<\/li>\n<li>Economic and Social Life<\/li>\n<li>Cultural Life<\/li>\n<li>Recreation, Physical Activities and Sports<\/li>\n<li>Environment and Sustainable Development<\/li>\n<li>Safety<\/li>\n<li>Municipal Services<\/li>\n<\/ul>\n<p>The MCRR is a municipal By-Law which is binding on all of Ville de Montr\u00e9al elected officials, managers and employees, including those working for boroughs or para-municipal or City-controlled corporations: the commitments therein are also binding on any person or organization performing duties on behalf of the City.<\/p>\n<p>Section 86.1 of the <em><a href=\"http:\/\/www2.publicationsduquebec.gouv.qc.ca\/dynamicSearch\/telecharge.php?type=2&amp;file=\/C_11_4\/C11_4_A.html\" target=\"_blank\" rel=\"noopener\">Charter of Ville de Montr\u00e9al<\/a><\/em> provides that the MCRR \u201cmay not serve as the basis for a judicial or jurisdictional remedy nor\u2026 be cited in judicial or jurisdictional proceedings.\u201d The <strong>only available recourse<\/strong> to ensure compliance with the MCRR, therefore, is with the <span class=\"caps-bold\">Ombudsman de Montr\u00e9al<\/span>.<\/p>\n<p>Even though the Ombudsman\u2019s usual jurisdiction is limited to the administrative actions and\/or decisions of the City, the MCRR allows her to intervene and investigate decisions that were voted by City Council, the Executive Committee or a Borough Council: this exceptional jurisdiction, however, applies only with regard to complaints based mainly on a commitment found in the MCRR.<\/p>\n<p>The <em>Montr\u00e9al Charter of Rights and Responsibilities\u00a0<\/em>is available in several languages, such as: Arabic, Simplified and Traditional Chinese, Haitian Creole, Spanish, Greek, Hebrew, Italian and Portuguese.
