History, role and mandate<\/h2>\n

History<\/h3>\n

IN 2002, Montr\u00e9al innovated by creating a municipal ombudsman service<\/strong>. At the time, there was no equivalent service in any Canadian city. The Montr\u00e9al City Council created the Ombudsman de Montr\u00e9al<\/span> position following the 2002 Sommet de Montr\u00e9al Workshop on Democracy during which citizens requested access to such a neutral and independent resource. Me Johanne Savard was the first person to hold the position, from 2003 to 2020. The current Ombudsman is Me Nadine Mailloux.<\/p>\n

Role and mandate<\/h3>\n

The quality of municipal services and the fairness of municipal decisions are at the very heart of the Ombudsman de Montr\u00e9al<\/span>\u2019s mandate. Citizens are entitled to fair<\/strong>, equitable<\/strong> and respectful<\/strong> treatment by Ville de Montr\u00e9al employees and representatives. As such, the Ombudsman handles complaints of citizens who believe they were treated unjustly by the Montr\u00e9al administration; the Ombudsman can also intervene at her own initiative.<\/p>\n

The Ombudsman investigates<\/strong> when she has reasonable grounds to believe that the municipal rights of a person or a group of people have been adversely affected, or are likely to be, due to an act, a decision, a recommendation or an omission of Ville de Montr\u00e9al (central departments and boroughs), a para-municipal agency or a City-controlled corporation.<\/p>\n

The Ombudsman de Montr\u00e9al<\/span> only acts as a last resort<\/strong>. Citizens who request her intervention must have submitted beforehand the alleged problem to the concerned department or borough Director. Moreover, the person or persons who submit a complaint must be personally affected by the situation in question.<\/p>\n

The Ombudsman de Montr\u00e9al<\/span> must abide by the law. However, she is not bound by the City\u2019s \u201cpast or customary practices\u201d. Her interventions often create golden opportunities to update or modernize some municipal practices or procedures which have been in effect for many years.<\/p>\n

The Ombudsman de Montr\u00e9al<\/span> has jurisdiction over the majority of administrative decisions of Ville de Montr\u00e9al and its representatives. In most instances, however, she cannot investigate complaints related to the decisions or behaviour of elected officials.<\/p>\n

The Ombudsman also offers the only available recourse<\/strong> to ensure the respect of the\u00a0Montr\u00e9al Charter of Rights and Responsibilities<\/em><\/a>. When a complaint is based mainly on this Charter, and only in such an instance, the Ombudsman de Montr\u00e9al<\/span> can exceptionally intervene with regard to decisions voted on by the City Council, the Executive Committee or a Borough Council.<\/p>\n

The Ombudsman de Montr\u00e9al<\/span> does not have jurisdiction over any employment or labour matters nor over any of the Soci\u00e9t\u00e9 de transport de Montr\u00e9al’s activities and decisions. Her jurisdiction over the Service de police de la Ville de Montr\u00e9al (SPVM) is also limited and she cannot intervene in regards to the acts or behaviour of peace officers.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
