What are the topics over which the OdM may or may not intervene?"},"content":{"rendered":"<p>A. The OdM\u2019s jurisdiction is limited to matters which are related to Ville de Montr\u00e9al\u2019s mandate and responsibilities.<\/p>\n<p>She intervenes whenever she believes, on reasonable grounds, that a person or a group of persons have been adversely affected, or are likely to be, following a decision, a recommendation, an act or an omission of Ville de Montr\u00e9al (central departments and boroughs), a para-municipal agency or a City-controlled corporation (see list hereinafter).<\/p>\n<p>Her jurisdiction also includes the decisions, recommendations, acts or omissions of any person or entity performing a task on behalf of the City (subcontractors\/representatives).<\/p>\n<p><strong>Some matters are specifically excluded from the OdM\u2019s jurisdiction. <\/strong><\/p>\n<ul>\n<li>She may not investigate any decision, recommendation, act or omission whatsoever of City Council, Executive Committee or a Borough Council, except with regard to complaints related to the <a href=\"http:\/\/ville.montreal.qc.ca\/pls\/portal\/docs\/page\/charte_mtl_en\/media\/documents\/charte_droits_en.pdf\" target=\"_blank\">Montr\u00e9al Charter of Rights and Responsibilities<\/a>;<\/li>\n<li>Also, she may not intervene in relation to the acts or decisions of any commission or committee created by City Council, Executive Committee or a Borough Council;<\/li>\n<li>She does not have jurisdiction over any aspect relating to employment matters;<\/li>\n<li>She may not intervene in relation to the acts or behaviour of an elected official or any member of his or her cabinet;<\/li>\n<li>She does not have jurisdiction over the behaviour of a peace officer from the Service de police de la Ville de Montr\u00e9al (SPVM);<\/li>\n<li>She does not have jurisdiction over the activities of the Soci\u00e9t\u00e9 de transport de Montr\u00e9al (STM) or of one of its employees.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>The OdM is also the \u201cguardian\u201d of the Montr\u00e9al Charter of Rights and Responsibilities. <\/strong><\/p>\n<p>She handles all citizens\u2019 complaints relating thereto: she offers the only recourse available to citizens, under the said Charter. When a citizen\u2019s complaint is essentially based on the provisions of this Charter, the OdM may exceptionally intervene, investigate and issue <span class=\"caps-bold\">Recommendations<\/span> with regard to the decisions of City Council, Executive Committee or a Borough Council.<\/p>\n<p>Moreover, the <a href=\"http:\/\/ville.montreal.qc.ca\/portal\/page?_pageid=3620,4034187&amp;_dad=portal&amp;_schema=PORTAL&amp;params_recherche=http:\/\/ville.montreal.qc.ca\/sel\/sypre-consultation\/recherchereglement?params=type_regl=999**critere=ombudsman**source=**type_recherche=0**total=0**crement=10**start_pos=1**acces=0**langue=en**instances=901**expression=ombudsman**etendue=titre**statut=1**no_reglement=02-146**no_regl_cond=**applic_territ=0**bro_orderdate=2014-06-02**bro_endorderdate=2014-06-02**utilisateur=&amp;has_been_there=1\" target=\"_blank\">By-law concerning the Ombudsman<\/a> specifically states that the OdM may NOT intervene:<\/p>\n<ul>\n<li>In relation to private disputes between citizens;<\/li>\n<li>In relation to a decision or a judgment issued by a court of law or a body performing judicial or quasi-judicial duties;<\/li>\n<li>When more than one (1) year has elapsed since the citizen has learned of the facts on which the situation he is complaining about is based.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Some of the para-municipal agencies and City-controlled corporations over which the OdM has jurisdiction:<\/strong><\/p>\n<ul>\n<li>Corporation des Habitations Jeanne-Mance<\/li>\n<li>Office municipal d&#8217;habitation de Montr\u00e9al<\/li>\n<li>Corporation Anjou 80<\/li>\n<li>Soci\u00e9t\u00e9 d&#8217;habitation et de d\u00e9veloppement de Montr\u00e9al<\/li>\n<li>Soci\u00e9t\u00e9 du Parc Jean-Drapeau<\/li>\n<li>Soci\u00e9t\u00e9 en commandite Stationnement de Montr\u00e9al<\/li>\n<li>Commission des services \u00e9lectriques de Montr\u00e9al<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>A.
